Cookie Policy

Last Updated: September 2026

This Cookie Policy explains how Niccolite ("we," "us," "our," or the "Company") uses cookies, pixel tags, web beacons, clear GIFs, local storage objects, software development kits (SDKs), and similar tracking technologies (collectively, "Cookies") on niccolite.net, accessible at niccolite.net (the "Site"), and through our software-as-a-service platform (together with the Site, the "Services"). This policy should be read together with our Privacy Policy at privacy-notice.php, our Terms of Service at service-terms.php, and our Terms and Conditions at site-terms.php, each of which is incorporated herein by reference.

By accessing or using the Services, you acknowledge that you have read, understood, and, where required by applicable law, consented to the practices described in this Cookie Policy. If you do not agree with this Cookie Policy, you must discontinue use of the Services and configure your browser or device settings to restrict or block Cookies as described in Sections 7 and 8 below.

1. What Are Cookies

Cookies are small text files that a website transfers to your browser or device when you visit a page. They allow a website to recognize your browser, remember your preferences, maintain session integrity, measure the performance of pages and features, and deliver advertising content that is more relevant to your interests. Cookies may be "session Cookies," which are deleted automatically when you close your browser, or "persistent Cookies," which remain on your device for a defined period or until you delete them. In addition to Cookies, we and our service providers may use pixel tags (also known as web beacons or clear GIFs), which are tiny graphic images embedded in web pages or emails that allow us to determine whether a page was visited or an email was opened, as well as browser local storage, mobile advertising identifiers, and SDKs embedded in our applications.

Cookies are commonly classified as "first-party" or "third-party." First-party Cookies are set directly by the Niccolite you are visiting — in this case, niccolite.net — and are generally used to operate the Services, authenticate users, remember account and language settings, and collect aggregate performance data. Third-party Cookies are set by a Niccolite other than niccolite.net, such as an analytics provider, advertising network, customer support platform, or payment processor, and are governed by those third parties' own privacy and cookie policies. We do not control the tracking technologies deployed by third parties, and their practices are described in Section 6 below.

Cookies may also be categorized by purpose: strictly necessary, functional or preference-based, analytics or performance-based, and marketing or advertising-based. We describe each category in Section 2 and provide additional detail on essential, analytics, and marketing Cookies in Sections 3, 4, and 5, respectively. Where a Cookie is not strictly necessary to deliver the Services you have requested, we will request your consent before placing it on your device, unless an exemption applies under applicable law.

The legal treatment of Cookies in the United States is primarily governed by a combination of federal and state law rather than a single federal cookie-consent statute. The Wiretap Act, as amended by the Electronic Communications Privacy Act, 18 U.S.C. § 2511 (see Van v. Zoo and In re Google Analytics), has been applied by courts to various tracking technologies, which reinforces our practice of obtaining consent for non-essential tracking. The California Online Privacy Protection Act, Cal. Bus. & Prof. Code § 22575, requires operators of commercial websites to disclose how they collect and use personal information and whether third parties may collect information about your online activities. In addition, the CCPA as amended by the CPRA, now codified at Cal. Civ. Code § 1798.100 et seq., and comprehensive state privacy laws in Virginia, Colorado, Connecticut, Utah, Texas, and other states impose notice, opt-out, and consent obligations that we honor as described below.

2. Types of Cookies We Use

We use the following categories of Cookies on the Services. The specific Cookies deployed may vary depending on the pages and features you use, your account configuration, your region, and your consent choices. We retain each Cookie only for as long as necessary for the purpose described, after which it expires or is deleted in accordance with our retention practices.

  • Strictly Necessary Cookies: Required to operate the Services, authenticate sessions, maintain security, balance network load, prevent fraud, and enable core functionality such as billing and account management. These Cookies cannot be disabled through our preference center because the Services cannot function without them.
  • Functional and Preference Cookies: Remember choices you make, such as language, region, time zone, dashboard layout, and accessibility settings, so that you do not have to re-enter them on each visit.
  • Analytics and Performance Cookies: Collect aggregated and statistical information about how users interact with the Services, including pages visited, features used, session duration, error rates, and referral sources.
  • Marketing and Advertising Cookies: Used to deliver advertising, measure campaign effectiveness, limit repetition, and build interest-based or cross-context behavioral advertising profiles.
  • Social Media and Integration Cookies: Set by embedded social media features, video players, chat widgets, and other integrated tools that allow you to share content or interact with third-party platforms.

Cookies may be "session" Cookies that expire when you close your browser, or "persistent" Cookies that remain for a set period ranging from a few minutes to twenty-four (24) months. You can review, manage, and withdraw consent for non-essential Cookies at any time through our cookie preference center, which is accessible from the footer of the Site, or through the mechanisms described in Sections 7 and 8.

We do not use Cookies to collect information that identifies you by name, email address, or account credentials for advertising purposes, and we do not permit third parties to use Cookies on the Services to collect sensitive information such as precise geolocation, health data, financial account credentials, or information about minors, absent your express consent where such consent is required by applicable law.

3. Essential Cookies

Essential (strictly necessary) Cookies are indispensable to the operation and security of the Services. They enable you to log in, navigate between pages, access authenticated areas of our SaaS platform, maintain the integrity of your session, complete purchases and subscription transactions, and protect against cross-site request forgery, credential stuffing, and other malicious activity. Without these Cookies, the Services cannot be provided, and therefore they are placed on your device on the basis of our legitimate interest in operating a secure and functional service, and are exempt from consent requirements under applicable law.

Typical essential Cookies used on the Services include session identifiers that link your browser to your authenticated account session, load-balancing Cookies that distribute traffic across servers, security tokens that verify form submissions and API requests, authentication Cookies that remember whether you are signed in, and Cookies that record your cookie consent selections so that we do not repeatedly prompt you. These Cookies generally expire at the end of your session or within a limited period thereafter, although some security and consent Cookies may persist for up to twelve (12) months.

Because essential Cookies are required for the Services to function, disabling them through your browser may prevent you from logging in, using core platform features, or completing transactions. We are not responsible for any loss of functionality, access, or data resulting from your decision to block or delete essential Cookies. If you believe an essential Cookie has been placed on your device in error, please contact us using the details in Section 10.

4. Analytics Cookies

We use analytics and performance Cookies to understand how visitors and customers use the Services, diagnose technical issues, measure the effectiveness of product features, and improve performance, usability, and content. These Cookies may be first-party or third-party and include tools such as Google Analytics and comparable measurement services. Analytics Cookies collect information such as the pages you visit, the time and duration of your visit, the features you interact with, your approximate location derived from IP address, your device type, browser type, operating system, screen resolution, and referring URL. As illustrated in In re Google Analytics, the use of analytics technologies has been the subject of litigation under federal wiretapping law, and we therefore treat analytics Cookies as non-essential, deploy them only with appropriate disclosures, and honor opt-out choices as described below.

We configure our analytics tools to support privacy-enhancing settings where available, including IP address anonymization or truncation, data retention limits, disabled data sharing for advertising purposes, and restricted access to raw event data. We use analytics data in aggregated or de-identified form to generate reports on traffic patterns, feature adoption, error rates, conversion funnels, and service reliability. Where analytics data is combined with account information, it is treated as personal information subject to our Privacy Policy, and it is retained only for as long as necessary for the purposes described above.

You may opt out of analytics Cookies through our cookie preference center, by enabling Global Privacy Control (GPC) or another recognized opt-out preference signal, or by installing the opt-out browser add-on offered by certain analytics providers. Disabling analytics Cookies does not impair the core functionality of the Services, but it may limit our ability to improve the Services based on aggregated usage patterns.

5. Marketing Cookies

Marketing, advertising, and retargeting Cookies are used to deliver content and advertisements that are more relevant to your interests, to measure the effectiveness of our advertising campaigns, to attribute conversions and sign-ups, to limit the frequency with which you see a given advertisement, and to build audiences for cross-context behavioral advertising. These Cookies may be set by us or by third-party advertising networks, demand-side platforms, social media platforms, and measurement partners. Marketing Cookies collect information such as pages viewed, products or features of interest, referral source, device and browser characteristics, and pseudonymous identifiers that may be linked to your activity across unaffiliated websites over time.

Because marketing Cookies involve the disclosure of information that may constitute a "sale" or "sharing" for cross-context behavioral advertising under the CCPA as amended by the CPRA, now codified at Cal. Civ. Code § 1798.100 et seq., we do not deploy marketing Cookies unless you have affirmatively opted in through our cookie preference center or as permitted by applicable law. Where processing constitutes a sale or sharing, you have the right to opt out of that sale or sharing, and you may exercise that right through the "Do Not Sell or Share My Personal Information" link available on the Site, through GPC, or by contacting us directly. We honor opt-out preference signals, including GPC, as required by California and Colorado law, and we treat a browser-based GPC signal as a valid request to opt out of sale, sharing, and targeted advertising for the associated browser or device.

We also comply with applicable requirements under the Virginia Consumer Data Protection Act, the Colorado Privacy Act, the Connecticut Data Privacy Act, the Utah Consumer Privacy Act, the Texas Data Privacy and Security Act, and other comprehensive state privacy laws that require opt-out rights for targeted advertising, sale of personal data, and profiling in furtherance of decisions with legal or similarly significant effects. Where we process sensitive data, we obtain consent as required by those laws. Marketing Cookies are not deployed on any portion of the Services directed to children, and we do not knowingly collect personal information from children in violation of the Children's Online Privacy Protection Act, 15 U.S.C. § 6501 et seq., or the Amended COPPA Rule, 16 C.F.R. Part 312 (2025 amendments in effect).

6. Third-Party Cookies

Certain Cookies on the Services are placed by third parties that provide services to us or that operate independently, including analytics providers, advertising and marketing networks, social media platforms, payment processors, customer relationship management and support platforms, content delivery networks, security and fraud prevention providers, and video or media hosting services. These third parties may collect information about your online activities across the Services and across other websites over time, including through the use of their own Cookies, pixels, SDKs, and device identifiers. We do not control the tracking technologies used by third parties, and we do not control how they use the information they collect. Their practices are governed by their own privacy policies and cookie policies, which we encourage you to review.

We require service providers and business partners acting on our behalf to comply with applicable law, to limit their use of personal information to the purposes for which it was disclosed, and, where applicable, to honor our contractual data protection obligations. However, where a third party acts as an independent controller or in a capacity outside our direction, its collection and use of information is governed by its own terms and policies, and it may retain, combine, or transfer that information in accordance with its practices. If you have questions or complaints about a third party's Cookies, you must direct them to that third party.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, Niccolite DISCLAIMS ALL LIABILITY ARISING FROM THE TRACKING TECHNOLOGIES, DATA PRACTICES, SECURITY MEASURES, OR OMISSIONS OF ANY THIRD PARTY, INCLUDING WITHOUT LIMITATION ANY DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES, LOSS OF DATA, LOSS OF PROFITS, OR LOSS OF GOODWILL. THIS LIMITATION APPLIES REGARDLESS OF THE THEORY OF LIABILITY AND WHETHER OR NOT WE WERE ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT SHALL OUR AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO COOKIES EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO US FOR THE SERVICES IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS (US$100). Some jurisdictions do not permit the exclusion of certain warranties or the limitation of certain damages, so some of the foregoing limitations may not apply to you.

7. How to Control Cookies

You can control and manage Cookies through several mechanisms. First, where required by applicable law, we present a cookie banner or preference center on your first visit that allows you to accept or reject each category of non-essential Cookies, and to withdraw or modify your consent at any time. Your consent choices are recorded and applied to the Cookies described in this policy. Second, you may opt out of the sale or sharing of personal information for cross-context behavioral advertising by clicking the "Do Not Sell or Share My Personal Information" link available on the Site, by enabling a recognized opt-out preference signal such as Global Privacy Control in a supported browser or extension, or by emailing [email protected].

Third, many advertising networks and analytics providers offer industry opt-out mechanisms, including the Digital Advertising Alliance (DAA) WebChoices tool and the Network Advertising Initiative (NAI) opt-out tool, which allow you to opt out of interest-based advertising from participating companies. These tools are not operated by us, and opting out does not mean you will stop seeing advertisements; it means that participating companies will stop delivering advertisements tailored to your inferred interests. If you use multiple browsers or devices, you will need to set your preferences on each one, and clearing your Cookies will remove your opt-out preferences and require you to reset them.

Fourth, you may exercise applicable privacy rights, including the right to know, access, delete, correct, and opt out, by submitting a request as described in our Privacy Policy. We will verify your request as required by applicable law and will not discriminate against you for exercising your privacy rights. Where permitted, an authorized agent may submit a request on your behalf with proof of authorization. Please note that certain information collected through Cookies is necessary for security, fraud prevention, legal compliance, or the provision of the Services, and we may decline a deletion request where an exception under applicable law applies.

8. Browser Settings

Most browsers allow you to block, delete, or restrict Cookies through their settings menus. The specific steps vary by browser and version, but generally you can find these controls under headings such as "Privacy," "Security," "Cookies and Site Data," or "Content Settings." In addition to browser-level controls, many browsers offer private or incognito browsing modes, which delete Cookies when the session ends, and "Do Not Track" or GPC settings, which transmit an opt-out preference signal. We honor GPC where required by applicable law; we do not currently respond to legacy "Do Not Track" signals as a standalone opt-out, but we do honor them where applicable law requires.

If you block all Cookies, including essential Cookies, you may be unable to sign in, access authenticated areas of the platform, complete purchases, or use other features that depend on session integrity. Deleting existing Cookies will remove stored preferences and may cause our cookie preference center to prompt you again on your next visit, since your prior consent choices are themselves recorded in a Cookie. Restricting third-party Cookies may disable certain embedded features, such as video playback, chat widgets, and social sharing, but will not generally affect the core functionality of the Services.

You can also manage tracking at the device level. Mobile devices include settings that allow you to limit ad tracking or reset your advertising identifier, accessible through your device's privacy menu. For more information about Cookies generally, and about how to manage them across browsers and devices, you may visit the resources published by the Federal Trade Commission, the DAA, and the NAI. We are not responsible for the content, accuracy, or availability of third-party resources or tools.

9. Updates to Policy

We may update this Cookie Policy from time to time to reflect changes in the Cookies we use, our practices, our service providers, or applicable law, including the Wiretap Act / Electronic Communications Privacy Act, 18 U.S.C. § 2511, the California Online Privacy Protection Act, Cal. Bus. & Prof. Code § 22575, the CCPA as amended by the CPRA, now codified at Cal. Civ. Code § 1798.100 et seq., the E-SIGN Act, 15 U.S.C. § 7001, the Children's Online Privacy Protection Act, 15 U.S.C. § 6501 et seq., and other applicable federal and state requirements. The "Last Updated" date at the top of this page indicates when this policy was most recently revised.

If we make material changes that affect how we use Cookies or how we collect, use, or disclose personal information collected through Cookies, we will provide notice as required by applicable law, which may include posting a prominent notice on the Site, updating the cookie banner or preference center, or sending an email to registered users. Your continued use of the Services after the effective date of any update constitutes your acceptance of the revised Cookie Policy to the extent permitted by applicable law. Where your consent is legally required for a new use of Cookies, we will request it before that use begins.

We encourage you to review this Cookie Policy periodically, and to review our Privacy Policy at privacy-notice.php for additional information about how we collect, use, disclose, retain, and protect personal information, and about the rights available to you under applicable law.
